Mission & Mandate

Our Mission

To promote and protect fair competition and consumer welfare in Botswana by adjudicating on breaches of the Competition Act and Consumer Protection Act, thereby ensuring a level playing field for businesses and safeguarding consumer rights.

Our Mandate

Established under the Competition Act, 2018 and Consumer Protection Act, 2018, the CCT is vested with quasi-judicial authority to adjudicate on matters involving anti-competitive practices, consumer protection violations, and related disputes with binding legal effect.

Origins & Historical Background

The Competition & Consumer Tribunal represents Botswana's commitment to establishing a robust regulatory framework for fair market competition and consumer protection in the Southern African region.

2014

Legislative Framework Development

Parliament began drafting comprehensive competition and consumer protection legislation to modernize Botswana's regulatory framework. Extensive consultations were conducted with stakeholders, civil society, and international experts.

2018

Legislation Enacted

The Competition Act, 2018 and Consumer Protection Act, 2018 were passed by Parliament, establishing the comprehensive legal framework for regulating markets and protecting consumers in Botswana.

2019

Official Establishment

The Competition & Consumer Tribunal was officially established on 1st January 2019. The first Chairperson and tribunal members were appointed following a rigorous selection process. The Secretariat was established to provide administrative and operational support.

2020

First Cases Adjudicated

The Tribunal began adjudicating on competition and consumer protection matters, establishing important precedents. The E-Filing system was developed to facilitate public access to the tribunal process.

2023

E-Filing Portal Launch

The digital case management system was fully launched, enabling 24/7 online filing and case tracking for the public. This innovation improved transparency and accessibility of tribunal services.

2026

Continued Growth & Evolution

The Tribunal continues to strengthen Botswana's competition and consumer protection framework with landmark rulings, expanded capacity, and enhanced stakeholder engagement across all sectors of the economy.

Organizational Structure

The Tribunal is organized into key functional areas to deliver its mandate effectively:

Adjudication Chamber

The core judicial function. Headed by the Chairperson and composed of experienced tribunal members. Responsible for hearing cases, reviewing evidence, and rendering binding decisions on competition and consumer matters.

Secretariat (Administration)

Provides administrative, legal, and operational support. Includes registry, legal services, finance, HR, and communications functions. Ensures efficient tribunal operations.

Technology & Systems

Manages the E-Filing Portal and case management systems. Oversees IT infrastructure and data security. Ensures cybersecurity compliance and system reliability.

Communications & Outreach

Handles public communications, stakeholder engagement, and awareness campaigns. Manages media relations and publishes tribunal decisions and updates.

Justice Ramotshela brings over 20 years of judicial experience, including 15 years in the High Court specializing in commercial law and constitutional matters. Holds a Master's degree in Competition Law from the University of Cape Town.

The Secretariat

The Secretariat is the administrative and operational arm of the Competition & Consumer Tribunal. The Secretariat is headed by the Executive Director who reports to the Chairperson.
